Self Catering Cottages Terms & Conditions
Reservations of all self-catering accommodation, whether made by telephone, fax, in person, in writing or email are accepted by Kinnaird Estate, hereinafter referred to as KE, on the following conditions.
Contract of Hire
The Contract of Hire is governed by Scottish law and jurisdiction and is not effective until KE dispatch written confirmation of the booking to the Hirer. The contract is for the hire of the property for holiday purposes only. We do not accept bookings from Hirers under 18 years of age.
Initial Payment
Bookings will be confirmed upon receipt by KE of the required deposit payment. However, if the booking is made within six weeks of the holiday commencement date, the full accommodation rental will be required.
Balance Payment
The Balance of the Hire will be due for payment six weeks before the holiday commencement date. KE reserve the right to cancel a holiday where full payment has not been received less than 21 days before the holiday commencement date. The deposit paid on such booking is not refundable.
Confirmation of Booking
Once KE has issued a Confirmation of Booking, you are responsible for the total published price of the property and extras shown on the confirmation.
Booking Cancellation
If you are forced to cancel your holiday you must inform KE immediately. Reservations cancelled within 4 weeks prior to arrival will be charged for in full, unless the cottage is re-let to another client. All payments refunded will incur a £50 administration charge.
Party Numbers
The maximum number of persons stated must not be exceeded.KE reserve the right to refuse admittance if this condition is not observed. In addition, KE reserve the right to refuse or revoke any bookings from parties that may in their opinion (and at their discretion) be unsuitable for the property concerned.
Dogs
Dogs are permitted in our cottages, but must be kept to the floored areas and off the furniture, and we would request that they are supervised at all times on the estate. There will be a charge of £35.00 per stay for all dogs in order to cover excess cleaning costs. In the event of any damage, you will be liable for any costs involved.
Smoking
Smoking is not permitted in any of the cottages.
Your Responsibilities
For the whole of the period included within your booking, you will be responsible for the property and will be expected to take all reasonable care of it. The property and all equipment and utensils must be left clean and tidy at the end of the hire period.
Damage
All damages and breakages are the legal responsibility of the Hirer, and their cost shall be refundable on demand. However, minor damage or breakages will not normally be charged except in circumstances where extra cleaning is required or there is damage beyond what is reasonably expected. KE reserve the right to charge the hirer for any additional costs incurred as a consequence and may at their discretion refuse future bookings.
Disruption
Further, KE will not be liable to you, any member of your party or person visiting the property during the period of your hire of it for happenings outside its reasonable control, such as breakdown of domestic appliances, plumbing, wiring, temporary invasion of pests, damage resulting from exceptional weather conditions or other unforeseeable circumstances.
Legal
In the event of any dispute between parties it shall be referred to the jurisdiction of the Scottish courts only and any actions shall be heard in the court for the area in which the property is situated. Any contract between the parties shall be governed by Scottish law and jurisdiction.
Availability
The Hiring Contract is made on the understanding that the property and its facilities as published will be available for the dates stated. In the unlikely event that a property is not available through events arising outside the control of KE then KE may be forced to cancel the booking. You will be advised as early as possible. Where possible, you will be offered suitable alternative accommodation, which, if not acceptable, will entitle you to a refund of all monies due. You will not as a result have any further claims against KE. Please note that reservation requests taken via our website are not confirmed bookings until we have contacted you and received a deposit.
Fishing Terms & Conditions
Should you cancel your booking a refund will only be made if your fishing is re-let.
The rod prices quoted are inclusive of VAT at the current rate of 20.00%.
All anglers are to contact the relevant Ghillie by telephone a minimum of 24 hours prior to their fishing date to confirm participation (contact details are below). All anglers are to report to the Ghillie at the fishing hut at 9.00am. Fishing is not permitted before 9.00am daily.
Life jackets are to be worn by anglers at all times while fishing (life jackets are available in the fishing hut).
Suitable eye protection is to be worn by all anglers at all times while fly fishing (protective glasses are available in the fishing hut).
All children under 16 years old must be accompanied by an adult.
Spinning or worm fishing (when permitted via TDSFB guide lines) will be restricted to certain areas of the beat during suitable fly fishing conditions and is solely at the discretion of the Ghillie.The use of natural prawn or shrimp baits are prohibited.
All anglers are to cease fishing at 1pm and return to the fishing hut. Fishing is not permitted through the lunch hour and will not recommence until 2pm.
Whilst we do our best to ensure guests' safety and comfort we can accept no liability for loss or damage, whether to persons or property, arising out of their fishing here, guests are particularly reminded that the Fishing Bothys are not secure against theft.
Fishing ceases at 5pm daily (unless pre-authorised by the Ghillie).Anglers are requested to take photographs of any fish landed and forward them via MMS or email to the Ghillie on the same day.No salmon should be beached at anytime. The use of a landing net is mandatory. Landing nets must be carried by all anglers at all times.All anglers who do not carry weigh net landing nets are requested to accurately measure the length of any fish landed against their fishing rod for approximate weight identification purposes. A tape measure and length to weigh conversion chart is located in the fishing hut.Where appropriate all salmon fishers will be required to comply with instructions to clean tackle which has been used on a fishery where there is a risk of contamination by the Gyrodactylus Salaris parasite and sign a declaration supplied by Kinnaird Estate.All closed gates on the estate must be re-closed after passing through.The Tay District Salmon Fishery Board Rules & Recommendations must be adhered to at all times and a copy is displayed in the fishing hut.No litter or nylon (including cigarette butts) are to be left on the estate and should be brought back to the fishing hut for disposal.Failure by fishing clients to fully comply with any of the above beat rules may result in an immediate termination of their fishing let without refund or compensation.
The Ghillie's word is final and must be adhered to at all times.
